While telemental health touches on some federal laws and regulations (e.g., the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”)), most of the significant legal and regulatory issues related to the provision of telemental health services involve state law, and states have taken varying approaches to regulating telehealth services generally and telemental health services in particular. This has resulted in an inconsistent patchwork of laws and regulations that vary widely by state.
